Children's clothing producer and marketer Healthtex Apparel Corp has accused a firm of violating its trademark contract by hiring a third company to make brand-name fashions.

The Delaware-based company claims bankrupt Maine-based Kent Inc has breached its contract by getting New York-based Nazareth International Inc to make its trademarked apparel.

Healthtex, which has asked a bankruptcy court for an injunction, also claims Kent failed to make royalty payments on the sales of goods it made and marketed under the Healthtex trademarks.

A court is due to rule on matter in the near future.
