Paul Frank Industries has won a temporary restraining order preventing designer and ex-partner Paul Sunich from using the Paul Frank trademark or tradename.

The company said: "We are obviously pleased that the court has granted our request for a temporary restraining order preventing Mr Sunich from using the Paul Frank trademark or tradename to start a new business.

"While Paul Frank Industries respects Mr Sunich's desire to pursue a new career, and we wish him well, we would expect and require him to respect all of the company's copyrights and trademarks, including the Paul Frank identity created by the company."

Sunich left the company on bad terms in November. He has accused his ex-partners, Ryan Heuser and John Oswald, of forcing him to leave the company then erasing his contributions.

He said they are now allowing themselves excessive pay packets and using privileges such as company cars for personal use after denying him his share of profits.
