US polyester suppliers have applauded a final determination by the Department of Commerce on anti-dumping duties for imports of fine denier polyester staple fibre from China, India, South Korea, and Taiwan.   

An anti-dumping and countervailing duty probe was launched last June in response to a petition filed by three major US synthetic fibre producers: DAK Americas, Nan Ya Plastics Corporation America, and Auriga Polymers.

Preliminary anti-dumping duties were issued in December, and the final determinations published yesterday (17 January), with the US Department of Commerce stating that producers and exporters of imports of fine denier polyester staple fibre from China and India are being unfairly subsidised by their respective governments at double-digit margins.

Exporters from China and India received countervailing subsidies of 41.73% to 47.55% and 9.50% to 25.28%, respectively.

The Commerce Department say it will now instruct US Customs and Border Protection to collect cash deposits from importers of fine denier polyester staple fibre from China and India based on these final rates.

“The United States will no longer sit back and watch as its domestic businesses are destroyed by unfair foreign government subsidies,” said Secretary Wilbur Ross. “We will continue to take action on behalf of US industry to defend American businesses, workers, and communities adversely impacted by unfair imports.”

In 2016, imports of fine denier polyester staple fibre from China and India were valued at an estimated $79.4m and $14.8m, respectively.

The US International Trade Commission (ITC) is conducting investigations to determine whether or not the domestic industry is harmed by imports of fine denier polyester staple fibre from China and India.  It is scheduled to make its final injury determinations on or before 2 March.

Meanwhile, US Customs and Border Protection has been collecting countervailing duties (CVD) in the amount equal to the preliminary subsidy rates in each country since 6 November 2017, when Commerce published its preliminary determinations. 

In 2016, the US collected $1.5bn in duties on $14bn of imported goods, found to be under-priced, or subsidised by foreign governments.
